Terms and Conditions - E.P.S. Services
1. General Conditions
These Terms and Conditions govern the engagement of services provided by E.P.S. Services, including assemblies, inspections, maintenance, and electrical and mechanical projects.
2. Payment
2.1. At the time of order placement, a payment of 30% of the total agreed amount is required. The remaining balance can be negotiated for payment in up to three installments, with payment due from the completion of the services.
2.2. In case of payment delays, a 2% penalty on the overdue amount will be applied, plus interest of 1% per month, as provided by the Brazilian Civil Code (Law No. 10.406/2002).
3. Obligations of E.P.S. Services
3.1. E.P.S. Services undertakes to perform the contracted services within the agreed deadlines, provided that all necessary conditions are met by the client.
3.2. Should there be a need for equipment rental or other actions for the execution of the services, the client will be informed in advance and must cooperate for the proper execution of the services.
4. Client Obligations
4.1. The client must ensure adequate access to the service location, as well as provide all necessary information and resources for the completion of the activities.
4.2. The client is also responsible for any delays resulting from their lack of cooperation or impediments at the service location.
5. Warranty
5.1. E.P.S. Services offers a warranty on the services provided, as agreed at the time of contracting. This warranty covers defects in execution but does not include issues arising from improper use, lack of maintenance, or unauthorized alterations.
6. Termination
6.1. In the event of early termination by the client, payments made are non-refundable, and the client will be responsible for any additional costs incurred by E.P.S. Services.
6.2. E.P.S. Services reserves the right to terminate the contract if the client fails to meet their obligations, including significant delays in payments.
7. Applicable Law
This contract is governed by Brazilian laws, especially the Brazilian Civil Code (Law No. 10.406/2002) and the Consumer Protection Code (Law No. 8.078/1990), where applicable.
8. Jurisdiction
For any disputes arising from this contract, the jurisdiction of the District of Itupeva, São Paulo is elected, with the waiver of any other jurisdiction, however privileged it may be.
